Client Responsibilities
Clients must provide accurate and complete information necessary for the successful completion of services. Failure to provide necessary information or delays in responding to requests may result in delays or cancellation of services.
Payment Terms
– Invoices: Clients will receive invoices detailing the agreed-upon costs for services rendered.
– Payment Methods: Payments can be made via bank transfer or Payoneer. All payments are due within 7 days from the date of the invoice unless otherwise agreed.
– Late Payments: Late payments may result in delayed delivery of services or the application of a late fee.
Intellectual Property
All content, materials, and designs provided by 104Digital remain the intellectual property of 104Digital unless otherwise agreed in writing. Upon full payment, clients receive a non-exclusive, non-transferable license to use the work for its intended purpose.
Service Revisions
Clients are entitled to a certain number of revisions for each service provided, as agreed upon in the project scope. Any additional revisions beyond the agreed-upon number may incur additional charges.
Limitation of Liability
104Digital will not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use our services. This includes but is not limited to, damages caused by errors, omissions, interruptions, delays, or defects in
services.
Third-Party Services
104Digital may recommend or integrate third-party tools or services as part of the project. We are not responsible for the performance, security, or reliability of these third-party services. Any issues or disputes regarding third-party services must be addressed directly with the service provider.
Termination of Services
104Digital reserves the right to terminate services at any time for any reason, including but not limited to breaches of these terms, failure to make payments, or failure to provide the necessary information. If services are terminated by 104Digital, a refund may be issued for any unused portion of the services.
Changes to Terms
104Digital reserves the right to change these Terms and Conditions at any time without prior notice. Your continued use of our website or services after any changes indicates your acceptance of the updated terms.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms will be subject to the jurisdiction of the courts of Victoria, Australia.
